DMCA Policy

Effective Date: 11/2/2024

This Digital Millennium Copyright Act policy (“Policy”) applies to the [www.growformeal.com/] website (“Website” or “Service”) and any of its related products and services (collectively, “Services”) and outlines how [Growformeal] (“[Growformeal]”, “we,” “us,” or “our”) addresses copyright infringement notifications and how you (“you” or “your”) may submit a copyright infringement complaint.

Safeguarding intellectual property is a priority for us, and we expect our users and their authorized agents to share this commitment. We adhere to a policy that promptly addresses clear notifications of alleged copyright infringement, in compliance with the United States Digital Millennium Copyright Act (“DMCA”) of 1998. The full text of the DMCA can be found on the U.S. Copyright Office website.

Important Considerations Before Filing A Copyright Complaint

Prior to submitting a copyright complaint, it is crucial to assess whether the use of the material could be considered fair use. Fair use allows for the brief quoting of copyrighted material under specific circumstances, such as criticism, news reporting, teaching, and research, without seeking permission or making payments to the copyright holder. If fair use has been considered and you still intend to proceed with a copyright complaint, it is advisable to first attempt direct resolution with the user involved.

Please be aware that under 17 U.S.C. § 512(f), you may be held liable for damages, including costs and attorneys’ fees incurred by us or our users, if you knowingly misrepresent that the material or activity is infringing. If uncertainty exists regarding whether the material in question is infringing, it is recommended to consult with legal counsel before submitting a notification.

We reserve the right, at our discretion or as required by law, to share a copy of your notification or counter-notification with third parties. This may include sharing information with the account holder engaged in alleged infringing activity or for publication. Should concerns arise about the forwarding of your information, you may opt to engage an agent to report infringing material on your behalf.

Notifications Of Infringement

If you are a copyright owner or an authorized agent and believe that material available on our Services infringes your copyrights, you can submit a written copyright infringement notification (“Notification”) using the contact details below, following DMCA guidelines. Provide the following information:

  1. Identification of the copyrighted work claimed to be infringed.
  2. Identification of the infringing material, including the URL(s) where it may be found.
  3. Information to enable us to contact you, such as an address, telephone number, and email.
  4. A statement affirming your good faith belief that the material’s use is not authorized.
  5. A statement attesting to the accuracy of the information provided, under penalty of perjury.
  6. A physical or electronic signature (typing your full name will suffice).

All Notifications must comply with DMCA requirements. Utilize a DMCA takedown notice generator or similar services for accuracy and compliance.

Initiating a DMCA complaint triggers a pre-defined legal process. Complaints are reviewed for accuracy, validity, and completeness. If your complaint meets these requirements, our response may include removing or restricting access to allegedly infringing material and permanently terminating repeat infringers’ accounts.

In case of removal or access restriction, we will make a good faith effort to inform the affected user, providing information about the action taken, including a full copy of your Notification (including your name, address, phone, and email), along with instructions for filing a counter-notification.

Despite the above, [Growformeal] reserves the right to take no action if a DMCA copyright infringement notification fails to meet all DMCA requirements.

Counter-notifications

Users receiving a copyright infringement Notification may submit a counter-notification under sections 512(g)(2) and (3) of the US Copyright Act. A counter-notification means that the material described in the Notification has been removed or access restricted. Please review the Notification for details and instructions on filing counter-notifications.

To file a counter-notification, provide a written communication with the following information:

  1. Identification of the removed or restricted material and its previous location.
  2. Information to enable us to contact you.
  3. A statement under penalty of perjury that you have a good faith belief the removal or restriction resulted from a mistake or misidentification.
  4. Consent to the jurisdiction of the federal district court.
  5. A physical or electronic signature (typing your full name will suffice).

You may be held liable for costs and attorneys’ fees if you knowingly misrepresent that the material was not infringing or was removed or restricted by mistake. If uncertain, seek legal advice before filing a counter-notification.

Notwithstanding any provision, [Growformeal] reserves the right to take no action upon receipt of a counter-notification. A compliant counter-notification may be forwarded to the person who filed the original Notification.

The process outlined in this Policy does not limit our ability to pursue other remedies for suspected infringement.

Changes and Amendments

We retain the right to modify this Policy or its terms related to the Website and Services at our discretion. Any modifications will include a revised date at the bottom of this page. Notice of changes may be provided through other means, such as the contact information you provided.

An updated Policy becomes effective immediately upon posting unless otherwise specified. Your continued use of the Website and Services after the effective date constitutes your consent to the changes.
